Privacy Information for Jobs Application Process with ad pepper media International N.V. and its Group Companies

Dear Applicant (“you”),

We at ad pepper media International N.V. and our subsidiaries ad agents, ad pepper media and webgains (hereinafter “ad pepper media group” or “we” or “us”) are delighted by your interest in our company and pleased that you are applying, or have already applied, for a position. You can find out how we meet our general obligation to provide information on our privacy policy at https://adpeppergroup.com/en/privacy-policy/. In this section, we inform you about how we meet privacy obligations in our HR processes, and in particular our jobs applications management, in line with the requirements of the EU General Data Protection Regulation 2016/679 (“GDPR”):

I. Scope of data processing and intended use

We process the data you send to us in connection with your application to assess your suitability for the position on offer (or, if applicable, for other vacant positions at our company) and to implement the applications process. The legal basis for processing your personal data within this application process is primarily provided by § 26 of the German Data Protection Act (BDSG), which permits the processing of personal data needed to reach a decision on establishing an employment relationship.

Your application data are collected and assessed by the HR Department. These data provide a basis for selecting the candidate to fill the position that has been advertised and for which you have applied. Based on your consent, we would also be pleased to assess your profile with other vacant positions within our group of companies. The legal basis for this data processing is provided by Article 6 (1) Letters (a) and (b) GDPR.

Suitable applications are then forwarded internally to the head of department responsible for the respective vacant position. Within the company, only those persons involved in ensuring the correct handling of our application process have access to your data.

To process your data, we use the services from the cloud software provider “HRworks GmbH”, Konrad-Goldmann-Str. 5 b, 79100 Freiburg, Germany, with which we have concluded a data processing agreement.

During processing, your data are only forwarded to the group company which advertised the vacant position for which you have applied. If you provide your consent to further processing your data, we will forward your data to group companies, but only located within the European Union. Your data will only be forwarded to locations outside the European Union if you explicitly apply for a position advertised for a non-EU subsidiary (for example in the USA).

If you are offered a position within our application process, then we will transfer your data from our applicant information system to our HR information system. Your data are not forwarded to third parties other than the above.

Should the data be required after the application process is completed, for example for purposes connected with court proceedings, then data processing may be performed on the basis of Article 6 GDPR, and in particular to protect our legitimate interests set out in Article 6 (1) Letter (f) GDPR. Our interest then includes asserting or rejecting claims.

If your application is unsuccessful, we will delete your application data after 6 months.

II. Your rights as an affected party

All individuals affected have the following rights:

  • Right to information (Art. 15 GDPR)
  • Right to rectification of inaccurate data (Article 16 GDPR)
  • Right to deletion (Article 17 GDPR)
  • Right to restriction in processing of personal data (Article 18 GDPR)
  • Right to data portability (Article 20 GDPR)
  • Right to lodge a complaint with a Data Protection Supervisory Authority (Article 77 GDPR).

All affected parties have general rights of objection (c.f. Article 21 (1) GDPR). In this case, the reasons for objecting to data processing have to be provided by you. If the data processing is performed on the basis of your consent, then you are at all times entitled to withdraw your consent for the future. The withdrawal of your consent does not affect the legitimacy of data processing previously executed on the basis of your consent for the period until the consent is withdrawn. We reserve a reasonable time to process your consent withdrawal.
